Fair Use Policy (brainstorming)

Indify widgets are subject to our fair use policy. Our free and paid plans should be fair and sufficient for almost all use cases. However, there are some use cases that we deem to be unfair or unethical.

Unfair or unethical use cases

  • Creating a large number of widgets under one of our upgrade plans and then cancelling your subscription
  • Having a large number of widgets (50+) on a public website with no active Indify subscription
  • Using Indify widgets on a public website that encourages illegal activity such as pirating or violent activities

In any of these above use cases or other such use cases, we may take action to enforce fair usage, including revoking your widgets in the case that their usage may be related to illegal activity.

Widget storage limits

Image Gallery widgets have a limit of 120MB for Free users, and 2GB for Pro users. If you need more space, please contact us so we can understand your use case, and we can discuss a custom plan that would be suitable.

Inactive accounts

Accounts that have been inactive for over 2 years will receive an email asking prompting to log in if the user wishes to keep the account. If the user doesn’t wish to keep their account, or doesn’t respond to the email within 60 days, the account may be deleted.

Storage limits

  • Define image storage limits (e.g. for Gallery images) for free users
    • We should understand the amount of storage the average Gallery user is using, and crack down on extreme cases. Almost all of the users below are free users. Plus one user, mariegans@outlook.fr has another account mariegans4@gmail.com which is ALSO on the Gallery widget leaderboard.
    • We can get detailed storage data per-user by using the Firebase SDK. Build an admin tool to track this info?

  • Inactive accounts
    • Set a limit for accounts that are inactive for a certain amount of time?
      • Could backfire, if users simply don’t need to update their widgets.
      • TODO: Check how many inactive users have inactive widgets (e.g. no views for 1 year). Follow up with an email to check in, or if no response after 60 days, deactivate their account + delete storage?

Define actionable items to enforce fair use

  • Track unusual behavior, such as free users who generate a ton of traffic or have lots of widgets (or both)

Introduction:

  • Indify reserves the right to limit, suspend, or cancel access to our services (even paid subscriptions) if a user’s activity violates this Fair Use Policy, poses a risk to platform stability, breaks the law, or is considered abusive.
    • We’ll always try to contact you first and work with you to resolve the issue before taking any action, unless the situation requires immediate intervention.

Indify retains the right, at its sole discretion, to suspend, revoke, or terminate any account or subscription, with or without notice, in cases of:
  • violations of this Fair Use Policy or the Terms of Service,
  • behavior that results in excessive or abnormal system load,
  • security threats,
  • illegal, fraudulent, or unethical activity, or
  • any usage that jeopardizes the stability or integrity of Indify’s infrastructure.

Indify is not liable for any loss resulting from such actions.

Examples of Extensive or Abusive Usage

Here are some illustrative (but not exhaustive) examples of usage that might trigger a review:

  • Putting high storage or bandwidth demand on our servers.
  • Using basic accounts to run a large-scale or high-traffic public-facing application, especially when embedded widely or used by external organizations.

What We Do When Usage Exceeds Fair Use

  1. Review & Contact
  2. If your usage seems unusually high or is straining our infrastructure, we’ll reach out to discuss. We may ask you to provide details about your usage pattern so we can better understand your needs.

  3. Custom Plan Offer
  4. If appropriate, we’ll propose a custom or enterprise plan. This could mean higher resource allocation (storage, refresh rates, bandwidth) or different usage terms.

  5. Transition Period
  6. If you choose not to accept a custom plan, we’ll give you time to transition to another solution. We’ll work with you to minimize disruption.

  7. Suspension or Limitation
  8. In rare cases, where usage is clearly abusive, we reserve the right to limit or suspend your access. This is always handled on a case-by-case basis.

Prohibited and Unfair Uses

In addition to resource-based concerns, certain uses are strictly disallowed:

  • Illegal or Unethical Use: Using Indify widgets to host or facilitate content or activity that is illegal, fraudulent, harassing, hateful, or otherwise unethical.
  • Security Violations: Purposeful attempts to breach system security, bypass usage controls, embed malicious content, or exploit our infrastructure.
  • Unauthorized Sharing or Reselling: Sharing your Indify account or plan with external third parties (outside your organization) or reselling Indify’s services without explicit agreement.
  • Copyright / IP Abuse: Uploading content that violates copyright, or using Indify to distribute content without rightful ownership or license.

Monitoring and Enforcement

  • Indify monitors usage patterns to identify behavior that may violate this policy.
  • We do not routinely inspect user content for privacy reasons—monitoring is focused on system metrics and infrastructure health.
  • When enforcement is needed, our first step is communication (warning, review). Only repeated or egregious abuse may lead to suspension.
